CHARLESTON, W.Va. — Senator Mike Stuart has resigned his seat in the state Senate.
Stuart’s resignation will take effect Thursday morning after he was confirmed Tuesday by the U.S. Senate to be the next general counsel for the U.S. Department of Health and Human Services after being nominated by President Donald Trump.
Stuart, R-Kanawha, served as Senate Judiciary Committee chairman. Gov. Patrick Morrisey will appoint his replacement.

Senate President Randy Smith offered his congratulations in a Wednesday statement.
“Mike has worked tirelessly for the Seventh District and the people of West Virginia, and I know that work will continue as he moves on to serve the Trump Administration in Washington. We wish him the best of luck as he takes on this new challenge,” Smith said.
In his resignation letter Stuart said he is excited about his new role.
“There is virtually no aspect of American life or any American family not impacted on a daily basis by HHS,” Stuart said.
During Trump’s first term Stuart was the U.S. attorney for the Southern District of West Virginia. He also has served as chairman of the state Republican Party.
